Des Moines Man Suffers Personal Injury From Brutal Dog Attack: Iowa Attacks Rising
A 62-year-old Des Moines man was severely injured when two dogs recently attacked him. The attack was so serious that the man was hospitalized and nearly lost his arm. As a result of the attack, one of the dogs had to be euthanized.
Statistics show that this incident was not isolated. Dog bite injuries are on the rise according to the Des Moines Register. Dr. Folkers, one of the doctors who treated the man, said he tends to victims of dog attacks five or more times per week. The Des Moines Register also noted a recent case in which a Dallas County woman’s nose had been bitten off by a dog.
An estimated 4.7 million dog bites occur each year in the Unites States according to the American Humane Association, and nearly 800,000 cases require medical attention. Children under the age of 12 are victimized by dog attacks 50 percent of the time. Seventy percent of dog-bite fatalities involve children under 10 years old. Insurance companies pay more than $1 billion to dog-bite victims each year.
Iowa law states that the owner of the dog is liable for all damages done to a victim if his or her pet attacks or bites a person. The law is not effective if the person attacked is attempting an unlawful act in direct contribution to the injury, however. This means that the owner does not need to be proved negligent in the case where his or her dog attacks someone. Compensation for injury can be acquired simply on the basis of the attack occurring.
Often times the dog attack occurs on the property of the dog’s owner. If this is the case, the pet owner’s homeowner’s insurance company may be responsible for providing the payment, depending on if the liability insurance policy covers dog bites and attacks. In any case, it is the responsibility of the injured party to act wisely by contacting an attorney or law firm that is experienced in handling dog bite personal injury cases.
